老公（H1-B）正在申请EB-1绿卡，学校sponsored. 

我是TN-1工作签证(加拿大公民工作签证)。老公学校律师说，做为配偶，我需要更换工作签证（从TN 换H1-B）才能递交 485 ，因为TN不是dual intent， 不能有移民倾向.

-That lawyer is wrong or he/she may just want more money!

老公打算自己递交140， 然后485加上我和孩子的名字。

-Your hu*****and, you and your child need to file seaprate I-485s, respectively. But I suggest that you do not file the I-485 until the EB-1B I-140 is approved.  If the I-140 is not approved, you do not need to file the I-485s, thus, you can save the money (I-485 filing fee and physical exam fee).

网上查了相关资料，

有人说我不用换成H1也， TN可以申请485，

-Absolutely right!.

有人说一定要换。

-Wrong!

肯请有经验的过来人帮忙指点，我到底是否要换到H1B.
