Question

Hi there, I got a question about laid-off on H1b. I was hired on July 1, and one month later, I asked my employer for 2-month leave absence without paid for my personal reasons. My employer gave me his permission, in other words, he wrote me a letter in which he allowed me to take 2-month leave absence without paid and he also made clearly in his letter my job will be resumed after two months. I made sure at that time as H1b employee I can take leave absence without paid. However, recently, I got a letter from my boss, in which he seems to imply that he is not satisfied with my work in his lab. So I am worrying about being laid off. My question is that if I were laid off, what time is the time that the BCIS officer considers the termination of my employment? Any reply will be highly appreciated
