If the family member or any employers in China discriminate 同性恋, the 同性恋 should seek help from Chinese court to protect his/her personal legal right, not seek immigration to US by asylum. Another issue is that your friend failed in the application for asylum using religin reason, and this will affect his future asylum application using another reason. I am sure USCIS must have asked your friend to leave US within one month, and he does not leave, he will never get the green card any more no matter what reason he will use for the future green card application.
