请问pjiang关于绿卡报税用treaty

你在文章“收到绿卡了，下一步该做什么？”(http://blog.wenxuecity.com/blogview.php?date=200709&postID=3149）里面写到：

像那些 J 什么的同学注意了，从现在开始你要以 "resident" 的高标准来严格要求自己。用 "nonresident" 的身份来报税，或引用任何的 "tax treaty"， 会导致 IRS 的稽查，和绿卡的取消。

请问这个是根据什么呢？我在网上查的信息说即使以resident alien身份报税（填1040而不是1040NR），同样可以使用treaty啊。什么地方导致绿卡不可以使用treaty？能否给个官方文件链接？多谢！

如果前半年是J1（并且在前36个月免税期内），后半年变成AOS然后变绿卡，前半年的收入是否可以用treaty来免税呢？
