1) 共同帐户,共同房产，共同租房合约 is one of the documents to demonstrate you 2 in a relationship of marriage, but not the only document.  When you 2 don't live together, find other documents

2) 外籍配偶在美国境外 does not matter, as long as you 2 live together.
