Thanks for the prompt response.  If I understand you correctly, you are saying my best option is instead of applying a waiver like what the INS told me to, I should try to dispute INS's finding which says I fall into the catigory of ineligibility for I-485, correct?

-Correct. Waiver can be the last choice.You should try the easy way and based on your des-cription, you should be qualified for the green card, so you should find lawyer to fight for it. If you finally fail, you still can apply for the waiver.
