Do not be misled.

If you get the H-1B, that is definitely wrong. I heard this happened before. It is due to the CIS mistake. You can maintain the H-1B status, but you are going to have trouble again when you file the I-485, when you need to show all of your visa documentation. You must have the waiver for J-1 to have the I-485 to processed.
