It deoends in EB1 or EB2, EB3 or EB5. Your hu*****and can file EB1/EB5-I-140 now, if his EB1/EB5-I140 get approved, you need J waiver and file I-485 with your hu*****and, so you can get GC soon.

If his EB2/EB3-I-140 get approved, you need to wait several years to file I-485, no need J waiver immediately.
