所以到了现在，我是2007 I-140 appeal中，I485被据。同时有一个2008 EB1a的I485 pending，但concurrently filed I140已经被据15个月之久了，估计这个I-485都已经被遗忘了。

-As long as the EB1a I-485 is pending, you are legally present though it will be denied soon or later due to the I-140 denial.
