我是绿卡持有者，在国内时离异有一个儿子，不过儿子一直没跟我，我们不是法院判的离婚，

请问能否申请儿子到美上学？

But you used family based category to sponsor your son immigration visa, it may take 3 more years for him to get the immigration visa.

Your divorce does not affect your son to get the immigration visa.
