The second one is correct for your current situation because you have not received a USCIS removal proceeding notice (ask you to leave) yet. Anyway, after your spouse's H1 approval, you need to leave US as soon as possible to apply for the H4 visa in China to come back, and can not change your status to H4 within US because your I20 expired.
