863211老师，是不是都会收到If USCIS send I-485 RFE for the employment status，
-Yes for every NIW/EB1A case.

那就是说，在485pending期间，一定要有有效的h1b才行？
-Not have to be H1, any legal status or just with AOS will be fine.

不是说只要交了485 就可以在美国合法等绿卡，即使当时没有有效身份也行嘛？
-Correct.

What I want let you understand is that you have to have a job or have a job offer when USCIS ask your employment status and then, USCIS can approve your I-485. Otherwise USCIS will deny your I-485. If you do not have a non-immigration status such as H1, you have to leave US after your I-485 denial. Before your I-485 denial, you have not problem to stay in US even if you do not have a non-immigration status such as H1, etc.
