我是美国公民。我侄女20岁了。如果我现在为我哥嫂申请移民，我侄女到I-130批下来肯定过二十一岁了。

但他们的I-130优先日期应该在我侄女21岁生日前。
-This is not helpful. The critical thing is the priority date (PD) has to be current before the CSPA age reaches 21. Because it may take about ten years for your I-130 PD to become current, your侄女 CSPA age will be > 21 (out-age). Thus, she can not get the immigration visa as her father's derivative status.

The CSPA age = your 侄女's age at the time of the PD is current - the time of the I-130 pending



如果我侄女在他们一家移民前不结婚，她受“CHILD STATUS PROTECTION ACT OF 2002”法保护吗？多谢了！
