我申请的eb2，priority date在06年6月。我的spouse在国内工作，准备8月底过来探亲，因为工作关系，只能呆2 个月。因为 priority date一直没有current，很长时间无法替他递交485。我现在的打算是

准备等他一过来，马上递交eb1，同时递交140和485，申请回美证，是希望他能够在2个月内拿着回美证回中国，决定辞职以后再凭回美证过来。因为根据现在排期的速度，很可能我的eb2在10月分会current，怕我的绿卡批太快，他无法以h4身份过来。

我不知我的eb1会不会被拒，是否我在eb2排期到了之后，在给他递一份eb2的485？这样我们就的交三份485的钱，也挺贵的。可是等eb2排期到的话呢，就算10月份排期到了，一个月他也来不及拿到回美证回国。

我的问题是：
1。现在回美证得三个月才办下来，如果他拿不到会美证，我得绿卡又批了，我是不是只能把他美国申请的485撤消，从国内再申请consuling process？
-Just wait and see and maybe his I-485 is also approved even if he is in China in this case. If his I-485 is denied due to his absence in US, you can file I-824 so that he can get the immigration visa in China. This may take 6 months to one year for him to get the immigration visa in China.

这样会花多长时间？ 我能不能撤消在美国他申请的485？

会有影响吗？他已经往返好几次了，都是h4签证。

我绿卡拿到后，他能再申请非移民签证吗？
-No for B1/B2, etc. due to the immigration intent.

2。 如果我的eb1被拒了，我能否relinkeb1 的485 到eb2？
-Your EB2 I-485 is still valid. But he can not relink his EB1 I-485 to your EB2 I-140 if his EB1 I-485 is denied.

我只听说过relink 到eb1，还没有听说过反着来的。
-Yes, you can relink from EB1 to EB2, but you need to it before the I-485 is denied.

3。 象我们的这种情况，怎样处理才最好呢？
