我已入籍，想申请哥哥移民。他10年前合法入境，但目前身份已经黑了，如果我申请他移民，他必须回国等排期吗？
-If his 身份已经黑了for more than one year, he will be banned to enter US for at least 10 years. But if he does not leave US, he can not get his green card under your sponsor. ONLY way for him to get the green card in US without leaving US is that he marries a US citizen, or he applys for political asylum.

还是可以在美国境内等。多谢回答。。
