Suppose you're working with either H1B or EAD when your I-485 pending. Only I-485 receipt is not enough to prove you are currently legal in the US. Usually the BMV renewed your DL based on the expiration date of H1B or EAD, but the exception occurred when my son renewed his but he did not have either H1B nor EAD (he's in college now with AOS status, he even has not been asked to show any proof as a college student) and issued him a five-year valid DL.
