我姐于2002年为我申请姊妹移民,I130于2009年12月批准.按现在的排期,还有大约一年排期到了.但我女儿今年年底即满21周岁.我的PD是2002/7.我和我先生和女儿分别于2001年和2002年来美,一直以H1B和H4 身份居住至今.
我的问题是
1.听说有儿童保护法,我女儿是否适用
-Yes.

是如何计算移民年龄?
-the "Child Status Protection Act" (CSPA) age = the child age when the PS is current - the I-130 pending time. For example, assume your priority date (PD) becomes current in December 2010 at you child' age 21, then, your child's CSPA age = 21 - (Dec. 2009 - July 2002) =21 - 7 yr 5 mon = 13 yr 7 mon
2.如果排期到我们三人是否可同时提交I485?
-Yes as long as you all keedp your status valid until the PD is current.

3.一般情况下,I485需多久能够批下来?
-Depends on whether the PD turns back or not. Normally several months.
