1. Yes. You are out of status for 5 months.
2. You should do the H1B premium petition asap. Most likely INS would approve your H1B status if there is no problem with your employer. After that, you may have to go back china to get H1B visa. Remember you have to leave the States before you are out of status for 6 months!!!!
