-Were the 父母绿卡 obatined through Employment based (EB) category? If yes, your kid can just file I-485 directly by follow-to-join using EB category, not use family based category by filing I-130. Thus, the kid does not need to go to China because his/her unlawful presence is less than 180 days before he/she files I-485. If he/she uses familfy based category, he/she has to go back to China because the priority date for family based F2A is about 5 years.
