Please help: I-485 or I-824?

I am asking for my hu*****and’s case. I am currently I485 pending and my PD will be current next month. My hu*****and is Canadian working at China. So he has no status in US at the moment.

Can I file I-824(CP process) for him next month or need to wait till my 485 approval?

If he comes back to US next month with a H4 visa (plan to get at US-Canada border), but only stayed in US for 3 weeks, can he use that time frame to file a I-485 and AP? Can he leave US before getting the receipt notice? My company’s lawyer tells me that he could not apply I-485 since he live in China now. Is it true?
