回复：关于国内孩子来上高中的身份问题.

我现在有美国绿卡,太太是公民.我的大儿子今年17岁,与他妈妈(我前妻)在中国.现在想把儿子接到美国上高中.他今年曾到美国一个家庭生活过两个月,是国内学校组织的交流教学项目.所以持有B-1签证．
-Because your wife is a US citizen and your marriage occurred before your son turns 18, your wife can sponsor your son's green card application. So, after your son enter US with b2 visa, he can apply for the GC within US (file I-130 and I-485 together), then, he can enter any high school to study. He of course also apply for the immigration visa in China using Consular processing under your wife's sponsorship.


另外一所私立学校要求F1学生签证，也可提供I20表帮助申请签证．
问题是,如果孩子以B1签证入境，入学可能不成问题,但停留期只有６个月．是否能转成F1学生签证？如果入境后再申请绿卡，移民局是否会认为欺诈？
-Wait for about 4 months and then, apply for the GC. Many people with B2 visa do that (e.g. many parents of US citizens).

如果用私立学校I20表在中国再申请F1学生签证，因为父亲是绿卡且生活在美国,他被拒签的可能性是否会比较大?
-It is difficult for him to get the F1 or b2 visa, but just try and nothing is impossible.

若直接在中国申请绿卡,批准的可能性多大?　
-Fine. No problem.
