回复：layoff紧急求助

老公的公司是NONPROFIT性质，昨天被LAYOFF，公司让他４５天内找到工作，否则就买一张机票让他回去。老公因为三个孩子和没工作的我，万分着急。老公的情况是这样：NIW，PD是２００６年５月１日，４８５递交于２００７年７月，２００８年我们用了一次AP回国。H１B（不占名额）在今年RENEW了，到２０１３年过期。两星期前老公递交了EAD申请，支票已兑。

我急切地想问几个问题：（１）如果４５天内找不到工作，是不是必须回国。
-No. Your spouse only need to find a job in the same/similar area, and his I-485 will be fine. He can stay in U.S. legally and find a job unless his I-485 is denied (he can use EAD to work if he can not keep his H1). If you and your kids have also filed I-485, you and your kids also can stay in US legally. So, ,don't worry.

（２）公司会不会递交一份雇佣终止材料给移民局。
-Yes.
如果递交了，对４８５的裁决和EAD的申请有没有影响。
-No.
（３）如果找到了工作，H１transfer有没有时间限制，比如超过４５天。
-If he find a job too late (e.g. > 3 months), his H1 transfer may have a problem and most likey he needs to go out of US to get an H1 visa. But he can use EAD to work, anyway.
