回复：紧急问- 老婆的H4过期了怎么办

怪本人太想当然,以为H4是依靠H1B的,本身就不需要办理了.我原来的H1B于今年3月底到期,H1B在到期前申请延续了.但是没有同时办理我老婆H4签证的延期,公司找的律师也没有跟我提过这个事情.我自己的H1B在5月初批下来了.但今天才知道H4也是要申请延期的,现在我老婆I-94上的到期时间还是我原来签证的到期时间3月底.

难道我老婆是黑身份了!!?
-Yes. She 黑身份了since her I-94 expired.

现在要怎么办?怎么办?
-Leave U.S. as soon as possible an apply for an H4 visa outside US to come back. Explain to the visa officer why she was out of status if asked.

老婆的H4还能延期吗??
-USCIS will not approve her H4 renewal application due to the unlawful presence. So, don't waste her time to file the application within US because the unlawyful presence continues even if she files the H1 renewal application. Once it is > 180 days, that will be big problem.
