1. Does 1099 has been issued already? If not, you are fine.
2. If under $600, they won't issue 1099 by law - Yes.
3. You don't need to tell your current employer about this story. HR only follows the protocol. Sometimes, they are very stupid.
4. If 1099 has not been filed, make sure to email the guy to confirm that they won't issue 1099.
In case, the 1099 has been issued, I believe you need to consult with your lawyer asap.
Future solution:
1. Register a company (anyone can do)
2. Get EIN number
3. In case you have any freelance job, make sure to give only your EIN number instead of your SSN.
