Uegent! 请教皮匠和863211老师

I have two urgent questions. My hu*****and and I filed 485 applications concurrently with my EB1-A I-140 petition. We got AP and EAD while I-140 and 485 are pending. My hu*****and used AP to visit China for some emergency. Later my EB1-A was denied and therefore both of 485 were denied. My hu*****and has H-1B visa and he is renewing the H1-B. I got EB1-B I-140 approved last week and we are thinking to re-apply 485. However, lawyer said that before we submit 485, my hu*****and should get the approval notice for the H1-B renewal and leave US and re-enter with H1-B. Is this true?

The second question is about my status. I got O-1 visa pproved in 4/27/09 and H1-B approved on 4/29/10.Company lawyer said that they will revoke the H1B so I can keep the O-1 visa. But I did not hear anything from them on this issue. My question is: if they did not revoke it, then my current status should be H1-B instead of O-1. In this case, can I still file 485? My immigration lawyer suggests me to leave US ans re-enter with O-1. Does it necessarily?
