回复：关于我的身份问题，急，请大家给点意见

移民局帮我向上级作了请示，我只能有两种方案：一是回国签证再过来，二是现在立即申请H4，以后再申请F1。

我现在担心有这些，
·我的身份已经失效有大半月，如果再申请H4会批吗？
-It should be fine if you file it shortly.

如果H4被拒，我的GAP还是存在的，或H4被拒，我现在被批得F1还有效吗？
-If your H4 is approved, the gap will be filled automatically. If h4 is denied, you need to go out of US to get H4 visa.

·从我身份失效到九月底开学要近五个月，如果不做任何努力，将来对我转身份或申请绿卡的影响到底有多大？
-You can not stay in U.S. with this gap without doing anything because the gap will accumulated after you begin study.

·如果我决定回国，因为我刚有小宝宝，要回去之前得有好多事要办，所以不知大家知不知道最多可以有多长时间身份过期了还可呆在美国，且对以后得签证不会有影响？
-One month should be OK.

I suggest you to file change your F1 to H4 in a few days and it should be OK.
