-Because you do not have a valid non-immigration status at this point, you can not get your H1 status within U.S. You can get the H1 visa outside U.S., but your pending I-485 will be affected (invalid). You had better get the AP for the travel. if you are under emergency, you can get the emergency AP in the USCIS local office.

2. 如果HR是错的，我可以申请H签证，我是否必须离境申请？
