。我这种情况是身分违例吗？有争辩的机会保住485吗？

是不是一定要用h1b签证回来以clean以前的的违例？
-No for your pending I-485, but yes for your new I-485 if you file it in the future. So you had better get the h1 visa to come back to keep your H1 status and thus, if your I-485 is denied, you can file a new I-485 again.

２。我现在的情况是我的PERM和１４０都批了，第二个h1在10月就要到期了，我看网上说现在h1很严格特别是我这种情况，所以本来想申请EAD的，是不是申请H1更保险？
-You had better keep your H1 status valid.

３。老公现在是AOSpendingwithH1（用了AP),如果我们的４８５被拒了，他要重新申请h1吗？
-Yes.
如果要，有多少时间可以让他申请？还是要离境？
-He can file H1 petition (new, renewal or transfer) to get back to H1 status within U.S. or get an H1 visa outside US to come back.

４。范律师说“如果没有就表示申请违反了H-1B的身份，因此不能在美国转换绿卡”。是不是说可以在中国申请４８５？
-Ignore it.
