Send it back to USCIS again and justifying it in the cover letter that your I-824 is based on your EB1B I-485 which has been approved because the PD is current Enclose the copies of your Eb1b I-140 approval notice, I-485 approval notice, and the evidence of the Eb1B PD is current (print it form the visa bulletin) and the rejection letter.
