-What does "黑" mean? If "黑" means he has not status, it is true. But If "黑" means he is unlawful presence, it is not true.

He has no legal status in this case, but it does not mean he can not stay legally. Out of status does not equal to unlawful presence.

Whether he is lawfully present is decided by the I-94 duration, not by his status.
