h-1b help!?

My lawyer sent out my H-1b application to CA center on Sep. 15th. But he didn't get the receipt from INS until now. Is there anything wrong with INS. Does this happen before? How long does it take to get a receipt from INS? I am so worrying about the 2005 cap. If I didn't get receipt number from INS, does that mean that I didn't get into cap?
Please help.
