I agree with you based on this statement you cited from the Department of State's document: 9FAM42.12-Rules of Chargeability. I am not sure whether there is any new USCIS Memo to explain it in details. You had better talk to several immigration lawyers to see what their opinion are (maybe different people have different understanding).
