回复：H4孩子正上学，递的485被拒，21岁后应该从哪里来保持身份？

如果一位当前H4的身份的子女，现在正上大学。由于已经递了485，有了移民倾向。21岁以后，不能作为子女继续享受H4的身份，又不能申报F1（因为有移民倾向），如果申请的485被拒，应该从哪些方面来保持身份？以下是我想到的建议，请大家帮助，看行不行。

1、对被拒的485递交MTR。这样，被拒的485又进入pending状态，孩子可以进入AOS状态。行吗？
-It is OK for a while, but it is not a final solution unless your NIW I-140 PD will be current in a short period of time.

2、找学校要I-20，强行申请F1，并强调485已经被拒，过去的移民倾向，已经因为485的被拒而没有了（自己都不能自圆其说）。这样的F1申请，可以吗？
-Just try to change your kid h4 to F1. Sometimes it may work if your kid is lucky because USCIS soemtimes might not be serious even if your kid has filed I-485.

3、找什么人权证据，说美国这么民主自由、法制健全的国家，这些跟父母来美国的孩子的权利受到损害。因为21岁而不能用父母的移民类别；因为递过485而不能申请学生签证，尽管他们实际上是学生。什么证据呢？
-Your kid may just go to Mexicon to apply for an F1 visa to come back. Normally, the Mexico US Consulate is not serious about that. I think there is a bigger chance than doing change of status from H1 to f1 within US.

4、还有什么别的法子？
