急问863211， pjiang老师，
我现在用的是Eb1a 的485 pending身份，刚刚找到了工作，马上可以收到offer letter. 倒霉的是，刚刚收到140 和 485的 denial notice.
新公司答应我一去，就可以帮我申请Eb1b, 我想appeal我的case, 用EAD卡去上班，同时递交一个新的Eb1b 140+485, 或者relink这个appeal 后重开的485 (不知道是否可能）。

另外就是问了两个律师，意见不同， 一个说可以重新申请485, 另外一个说，我没有非移民身份了， 不能再申请新的485, 请问哪个说法正确？
-To my knowledge, you need to have a non-immigration status (e.g. h1, etc.) or a parolee status (get it by using AP to enter U.S.) to be qualified for filing I-485. So, you had better ask your new employer to file an H1 petition for you if you were h1 status with h1 quote before. You may need to go outside US to get an H1 visa to come back to activate the h1 if your H1 approval notice has no I-94.

Another choice if that you can file MTR for your I-140/I-485, then get an AP to go outside U.S. and come back to get a parolee I-94, then you can file another new I-485.
