回复：离境1年重新申请

H1-B第五年，公司不给办绿卡，想现在离开美国，一年后再过来重新申请H1-B，请问-pjiang，小白兔，863211，　“一年”是指连续的一年还是累计的一年，我公司的律师说的是连续的一年，中间不能回到美国，哪怕只呆一天。是这样吗？谢谢！
-Your lawyer is absolutely wrong! Based on the immigration law, 8 CFR 214.2(h)(13)(i)(B), making short trips as visitor is not a problem. You just need to add the time spent in the US to the 1 year (cumulative to reach total one year).
