回复：就我的case继续问，如何成功返签

之前请教过我这种情况的返签问题：现在F1，公司给办H1, 现在身在国内；863211建议用consular processing 申请H1,然后返签。

我昨天联系公司的律师，告诉她我由于家庭急事已回国。但是她在email 里告诉我我的h1申请已经在1天提交，在此时不要用F1签会来，并建议下周再与我及公司的HR进行对话讨论。

显然，公司是按照我在美国的情况file的H1，而我现在国内，这样的申请能成功通过吗？
-I hope USCIS will find that you have left U.S. before your employer filed the H1 petition (from the I-94 you rpovided to the airlines when you left). If so, you will be OK. I think your lawyer will deal with this issue and you do not need to worry about that.

But if the H1 petition was filed before you left U.S., this petition will be denied.

如果我的h1申请材料在2天前由律师寄出，现在还可以改成consular processing 嘛？

在下周与律师及公司HR的电话会议中，我能为这种情况提出什么比较有价值的建议呢？
