皮匠,八兄看H1B9年时的再延3年的方法行吗?

本人OCT. 17,2001 获H1B, DEC, 24, 2001 进入米国开始为现公司工作. I-140 因为现公司第二次接到补材料支付证明时没提供USCIS要求的东东而被拒了,老板不想上诉,是在AUG. 2008被拒的. 现H1B DEC.1,2010 到期,为第9年完.

新公司在办H1B的转移,律师坚决认为无机会延期了,我很仔细的读了皮匠的博文,觉的还有机会今年底到期前在延3年.这是我给律师的电邮.
I did some research after you called me on Feb. 15.

I believe that there is a way to deal with my H1B status extension beyond 6 year limit without staying outside of the US for 1 year.


Step 1.

Start PERM asap.

Bxxx Cxxx supplies all recruitment ads used in the last 6 months.

PERM process takes 6-7 months average in 2009.


Step 2.

If PERM approved before Oct. 1, 2010, file Form I - 140 with premium processing, it should get result w/15 work days.

(Ask Form I - 140 premium processing must be done within 60 days before H1B expiration, this case Dec. 1, 2010 )


Step 3.
As law: AC21 104 ( c ), XXX's H1B is eligible to apply for 3 year extension with the Form I - 140 approved, IE, Dec. 1, 2010 to Dec. 1, 2013, and more Dec. 1, 2013 to Dec. 1, 2016 etc.
