Please Help: Am I still legal?

My hu*****and had his I140 approved. We are going to file I485 next month. I will also file I765 for my EAD. But my H1B1 will expire in December. If my EAD is not approved by that time, can I stay in US legally as 485 pending? Or do I need to apply H4 as a dependent of my hu*****and? Thanks for your kind help.
