J1 waiver - need your help !!

now on H4. I-485 pending. Lawyer found out that the advisory opinion on my J1 waiver from USIA that I do not need waiver a mistake. My nationality appears on advisory opinion notice is German (I did 2 year postdoc in Germany prior to coming to the states) while on my IAP-66 is Chinese. Our I-485 may be denied. very frustrated...

I was qualified for No-objection waiver while at work a few year ago. Now I do not have a job and hard to apply No-objection waiver. I want to persuade Chinese consulate to file No-objection waiver based on my qualifications before. Actually if it was not receiving the advisory notice that no waiver necessary, I had applied for no-objection waiver long time ago... suffering now. Here are my questions:

1. Does my current No-objection J1 waiver application conflict our I-485 approaval? I know J1 waiver goes to Department of States, and I-485 goes to USCIS. Anyone knows whether the two agencies share the same database? I do not want my J1 waiver application now affect our I-485.

2. What should I do if Chinese consulate is not willing to file the no-objection waiver for me?
