As long as your case is pending, you are okay. However, strictly to say, after your first H-1b expires, your employer has the right to suspend your work till your new H-1b is approved because you have no legal document to work until your new H-1b is approved. If you bet your PD, you can do this way, but I do not know why you do this way because you do not need to pay for your H-1b renewal, your employer does, so what bothers you?
