我目前在大学工作，做postdoc。刚刚工作一个月。现在有个工业界的offer。今天跟移民律师谈 h1b transfer的问题。
1）我问律师，我刚刚在这个大学工作一个月，办 h1b有风险吗？我好像听说有至少要工作俩个月的规定。可是律师说没问题。我怎么觉得这律师有点不靠谱啊。
俩位前辈觉得这律师说的对吗？

2) 后来我又跟律师说，如果我用premium来办理H1B tranfer。那样我就可以很快知道结果是批还是据。如果批了，就去工作。如果据了，就还留在现在这个大学做postdoc。
可律师说，如果transfer被拒，也不能再在现在所处的大学工作了。
-The lawyer is absolutely wrong and you of course can work for your current employer if the new H1 petition is denied. Because each person can have several h1 status at the same time, you may just ask the new employer to file a new H1 petition for you, not do the h1 transfer. Thus, it will not make confused. The difference between the new h1 petition and the H1 transfer is that you can work for the new employer immediately after you file the H1 transfer, but you can only work for the new employer after the new H1 petition is approved.

Because it is risky for you to work for the new employer before your new H1/H1 transfer approveal, it is not different to you whether your new employer file a new H1 or do h1 transfer.
