apply <留学人员豁免申请表>

Is it necessary that only after 1 year's staying in USA can I apply from Chinese embassy?
My boss can change my J-1 to H-1, but I have been in USA only 5 months, in this can I apply from Chinese embassy?
Any information is highly appreciated.
