863211老师，您好，谢谢您回复我上个帖子。我现在又有了一个新的问题。我现在H1,回国入关时候custom officer有给了一个新的i94,所以我现在又两个i94.今天收到employer E-Verify的email,"DHS Notice to Employee of Tentative Nonconfirmation". Reason for the notice: DHS could not verify your employment eligibility due to an issue with: your immigration information or your social security number.
我是今年10月份刚开始上班的，上班时候填I9的表时候，HR人说让我用I797上的那个I94 number(说要和I797 match).您说我是不是问题就出现在我应该应该填新I94?
-Correct. Your HR made mistake because they did not know the immigration law. When you left U.S. and provided the I-94 (from the H1 approval notice) to the Airlines/CBP, your h1 status terminated and the I-94 was over/finished. Then, you got an new H1 visa in a US Consulate in China and entered U.S., and you got a new I-94, and after that you reinstated your H1 status with the new I-94 duration. So, you need to send a copy of your H1 visa (you got it in China to enter U.S.) and the copy of your new I-94. Then, you will be fine.

Notice上面说，如果选择不contest the Tentative Nonconfirmation，it will result in termination of my employment.


您说我是不是改成新I94号码就可以了？
