Pjiang and gewei daxia: regarding mild misdemenor

In my 485 application for my family in 2007, my hu*****and, as a dependent, exposed his history of mild misdemenor which happened in 2006. Now he is applying for case seal at the court and trying to apply for greencard (EB1A) for our family. If the case is going to be sealed, does he have to admit in his application of this history? thanks
