回复：父母b2 签证来美， I-130 已批， 如何在美国获得绿卡而不必回国？

我的大哥是公民， 申请父母移民，但很不幸， 最近因车祸去世， 我办理父母B2签证来美处理后事， 到达美国一个月后，告知移民局已批准I-130， 请问在这种情况下， 应该如何处理？

After your brother's death, USCIS will revoke the approved I-130 unless the Attorney General in his discretion determines that for humanitarian reasons revocation would be inappropriate. Also, I do not think the humanitarian reasons would apply to your parents at this movement. So, your parents's green card applications would be revoked/cancelled.

是回国按照正常的程序等待呢， 还是可以在美国这里申请身份调整， 在这种情况下还要重新找个sponsor吗？
-Only you (or your other US citizen brothers/sisters, if any) can be the sponsor for your parents' green card application after you become US citizen. No any other people can be your parents' sponsor for the green card. So, your parents may need to go back to China after their visa expires. Of course, they can stay illegally in US until you become a US citizen some time later, and then you can sponsor them to get the green card (their unlawful presence does not affect their future green card application no matter how long it is).

但我的身份是h1b, 听说最好找个公民亲属做sponsor ?
- 公民亲属 is not qualified to be the sponsor unless he/she is your parents'kid.
