问题来了,王五同学在旧的I-94过期之前同时在失去工作之前申请了第一个AOS,在旧I-94过期之后同时在失去工作之后(在前一个AOS pending期间)又申请了第二个AOS.

在距离他authorized status 失效之后(被layoff之后)的200天和旧I-94失效179天的时候,(注意两者不是同一天)第二个AOS获得批准并且有了新的I-94,又过了几天,第一个AOS被denied.

- Since the 2nd COS was filed in authorized stay, it was not approvable until the 1st COS, which was file in authorized status, was approved in prior.

However USCIS did approve the 2nd COS without holding it to approval of 1st COS, that would be their problem (actually their mistake). The approval notice with I-94 indicated you were not considered OOS, or OOS was forgiven by USCIS.
