急啊！请教，H1B延期和EAD延期可以同时申请吗？

现在的H1B今年12月到期，我8月就找公司律师提交了延期申请，现在买房子，需要H1B的延期证明。可是 我向律师要的时候，他却不理我，我找了公司HR，他们也不回。
我现在很担心，那个阿三律师到底有没有把我的申请递交上去。
请问，我现在可以不可以自己申请EAD，以防那个啊三真的没给我递申请？
另外，EAD延期多久能批下来？
