我的LCA被拒了因为律师的低级错误，现在在等第二次LCA，可能要9/29才有结果。
我的H1B 9/30 过期。想请教您下列问题：
1）如果9/30那天不能送出延期申请， 10/1以后我有身份问题么 ？ （有AOS）
-Technically, you are out of status. But you should have no problem to get your H1 approval for only these few days (H1 has ten day grace period after it expires).
2）需要申请H4 作为 backup么？
-Not need.
3）如果 9/30送出了延期申请，但是不可能拿到receipt notice， 10/1后还可工作么 ？
-Technically, no. But practically, yes because your H1 extension will be approved fully with the I-94 and thus, your status has no gap after your H1 extension is approved (new H1 effective date will be 9/30/2009, the same date of your old h1 expiration).
