Can I premium process the appeal for NIW-based I-140

NIW denial notice was sent June last year and the appeal started in Aug. Last month my case was tranferred to DC appeal center. 13 months has went by! Can I premium process the appeal? I called my lawyer and the answer was NO because of NIW. Is it true?
I am going to process PERM and put on Ads next month. I still cross my finger._(u)
