回复：我父母是否已经非法居留了

父母的I94 到7月25日到期，签证到2010年一月13 日到期。我由于忙，到6月24日才帮他们递了延期申请，9月2日受到电子邮件说延期申请被锯了。我想问问：
１。 他们是否从7月25日就非法居留了？
-No. The unlawful presence will be counted form the date of the extension denial or the date to leave USCIS indicated on the denial notice.
2. 如果9月30 日回国，在签证到期前还能回来吗？
-The visa has been invalid because of the extension denial. So, they can not use this visa any more and have to apply for a new visa to come to US in the future.
因为我9月要出差10天，小孩没有人照顾，所以想我出差回来后再走。我single parent.
3. 如果现在回去，也算已经非法居留。我打算他们再呆几个月，但不超过180 天。 因为这段时间要找工作，会去面试。那么从他们回去起，3年不能申请签证，是吗？
-They will not be banned to enter US if they leave before unlawful presence > 180 days. But their future visa application might be affected depdending on the VO personal judgement.
